I herby register my opposition to the legislation of the proposed Trans Tasman Agency and Treaty. I also oppose the implementation of the Therapeutic Goods Amendment Bill 2005, which will effectively regulate health supplements out of existence in New Zealand. I DO NOT support the proposed Trans Tasman agency to regulate therapeutic products and medical devices. I DO SUPPORT a new system of regulation under a New Zealand regulator, where Natural Health Products are recognised as a separate category from both medicines and foods, providing risk based controls as per the recommendation of Parliament's Health Select Committee which includes the following; • New Zealand based regulation for Natural Health Products and Medical Devices • Mutual Recognition with Australia instead of harmonization • Risk based system of regulation • Based around a simple product listing system • Based on a negative list of products (that means defining the products that may not be used rather than limiting the products that can be used) • Includes Good Manufacturing Practice requirements • Sensible labeling laws• Allows for innovation • Includes clear monitoring and enforcement rules along with random testing to ensure compliance. 1/ I say NO to the passing the Therapeutic Goods Amendment Bill 2005. 2/ I say NO to passing any implementing legislation pertaining to the JTA treaty and Trans Tasman Agency - This JTA treaty legislation must not be implemented before or after July 1, 2005. 3/ I say NO to the planned "super corporation" (Joint Trans-Tasman Agency) and all its obligations to align itself with the WTO (Marrakesh Agreement - 15 April 1994), which can and possibly will encompass future restrictive codex legislation via Free Trade Agreement instrumentalities (trade barriers). 4/ I object to this JTA being run as a corporate entity. 5/ I object to destroying the New Zealand natural health industry and imposing Australia's restrictive regulations on New Zealand! I also demand a Royal Commission enquiry into the double standards and bias of the TGA with regards to protecting and abetting the pharmaceutical industry, for example; The Australian Therapeutic Goods Administration (TGA) instigated a class 1 recall “can cause death or permanent injury” of all vitamin supplements produced by PAN after a pharmaceutical drug, dimenhydrinate (Travelcalm) was found to have caused minor injury, yet the TGA only issued a class 2 recall “defects could cause illness…but are not class one” When VIOXX, the anti-inflammatory drug, was found to have killed 55,000 Americans (estimated 138,000 deaths) and VIOXX is still available for sale? The TGA has not conducted any trails on adverse reactions to VIOXX in Australia. In the UK and Australia, 76 deaths, 8737 adverse reactions linked to Zyban the anti-smoking drug yet still no recall by the TGA, why not? A parliamentary inquiry is not enough as it will be white washed like so many other government enquiries. Nothing short of a Royal Commission will come close to identifying the collusion between politics, government and the pharmaceutical industry! The UK House of Commons report identifies how government agencies collude with the pharmaceutical industry.
