Wills are a rich source of information for Family Histories.  In this new section attached to the index of Warry WILLS it is intended to provide transcripts of Warry wills and other wills that mention Warry’s. Some wills no longer exist due to bombing in WW11 so the extracts are just the notes taken from these wills by previous Warry researchers

Stephen Warry , 2 June 1530. To be buried in the cemetry of Chard;

to the mother church of St Andrew of Wells (Wells Cathedral) 4d;

to the high alter of Chard for tithes and oblations 4d;

to the altar of the Blessed Mary 4d;

to the altar of of St Katherine 4d;

to John Antony and Elizabeth Antony my nephew and niece the great bowl with two dessert dishes

Will of Walter Warry , Chard, Proved at the PCC 1 June 1582

 

In the name of God amen. In the twentyninth day of September in the yeare of our Lord God a thousand five hundred and eightye and in the one and twentye year of the raigne of Elizabethe by the grace of God of Englande France and Irelande Queene defender of the faith etc.

I Walter Warry of the parrishe of Chard being whole in bodye and perfecte of mynde thankes be unto allmightie God doe make this my last will and testament in manner and fourme followinge.

First I bequeathe my soule unto allmightie God and my bodye to the Christian burial in Charde churcheyarde.

Item I gyve to the maintenance of the Churche of Charde twentye pence.

Item I gyve to the poore people of the lande of Charde three shillings four pence.

Item I gyve to the everye of my Godchildren four shillings apiece.

Item I gyve to Robert Warry of Baydge in the parrishe of Winsham three shillings foure pence.

Item I gyve to William Warrye of South Charde three poundes sixe shillinges eight pence.

Item I gyve to Marye Warrye of the parrishe of Burporte three shillinges fewer pence.

Item I gyve to Alice Peeke of the parrishe of Wayforde three shillinges fewer pence.

Item I gyve to Julian Warrye my brothers daughter three shillinges fewer pence.

Item I gyve to my sonne Robert Warrye sixe poundes thirteen shillinges fewer pence.

Item I gyve to William Brangwyn my wyfes sonne six poundes thirteen shillings fewer pence.

Item I gyve to Julian Anthonye sixe poundes thirteen shillings fewer pence and a cowe not the best nor the worste but at the discresion of my executive.

Item I will that my sonne Robert shall have and occupye all suche gooddes and stuffe as is in my house at his need when tyme shall serve and with my ploughe ( my owne busynes done) and take the profitte thereof.

Item I gyve to Robert my sonne a cowe and sixe chilve sheepe.

Item I gyve to Agnes my daughter in lawe sixe weathers.

Item I gyve to Thomas Warrye my sonnes sonne a cowe and a ewe sheepe.

Item I gyve to Elenor my sonnes daughter a ewe sheepe.

Provided that my sonne Robert shall have halfe my househouldstuffe after my wyfes decease and my featherbed a paire of blankets a paire of sheetes and a tester and a coverlet  and my wayne and wheeles and all my plough geare thereto belonginge or apperteyninge after my wyves decease.

The reste of all my goods moveable and unmoveable I gyve to Elenor my wife whome I doe make my full and whole executive of this my last will and testament and shee to paie my debtes if anye be and to receive my debtes. Hereto I make overseers Thomas Lumbard, Walter Carhill and John Carter . Anf theye to have for theire paynes three shillings fewer pence apiece. In witness hereof William Samuell curate, Walter Carhill clerk, Thomas Lombarte constable, Thomas Bowridge, Robert Peter, John Fuette.  

      

Will of Elenor Warry, Chard, Proved at the PCC 1 May 1585

 

In the name of God amen. In the yeare of our Lord God onethousand five hundred eightie four and in the first daye of November I Elenor Warrye widowe late the wife of Walter Warrye of the parish of Charde being whole in bodye and perfecte of memorye (thanks be unto allmightie God) doe make my last will and testament in manner and fourme followinge.

First I bequeathe my soul unto allmightie God my maker and unto Jesus Christ my redeemer and unto the holye ghoste my fourtifier and my body to be buryed in the churchyarde of Charde.

Item I give to the mayntnance of the churche of Charde twenty pence.

Item I give to the poore people of the lande of Charde sixe shillinges eight pence.

Item I give every of my godchildren sixe pence apiece.

Item I give to the mayntnance of the highewaye or Churche pathe betweene my house and sonne mead lane twelve pence.

Item I give to William Brangwyn my sonne three ewes nor of the best nor of the poorest but at my overseers discrescion.

Item I give unto the same William a heifer bullocke of a yeare olde.

Item I give unto the same William score of sheepe as they shall come for the of the fold one with another.

If I dye before they be shore my executors to have the flyses at sheore tyme.

Item I give to the same William Brangwyn a duste bedde a payre of blankets a payre of sheetes and a coverlett.

Item I give the same Williamtwoe coffers which weare his fathers.

Item I give to Agnes Warry my daughter in lawe a hoyffer bullocke of twelve months old.

Item I give to Thomas Warry my sonnes sonne a coffer and to Elenor his daughter a coffer and every of them a chilver sheepe at my decease.

The rest of all my goods moveable and unmoveable not given nor yet bequeathed I gyve and bequeath unto Robert Warrye my sonne whome I make my full and whole executor he to bestowe of that as he shall think ye goods to the glory of God.

And hereto I make my overseers Thomas Lombarde and Walter Carhyll. And they shall have for their paynes to see this truly performed three shillings fewer pence apiece.

In witness hereof John Wilson vicar, Thomas Lombard, Walter Carhill with others.

Item I gyve to my sonnes youngest daughter a ewe sheepe. John Wilson vicar.     

 

 

 

 

Will of Richard Warry, Chard, Proved at the PCC 7 November 1597

 

In the name of God amen. I Richarde Warrye of Forton in the parish of Chard victualler beinge sycke of bodye but whole and sound of mynde all praise and thanks be to the Almightie God doe make and ordayne this my last will and testament in manner and forme following.

First and princypallie I bequeathe my soule into the handes of Almightie God my creator and on the Saviour and Redeemer. And my bodye to the Chrystyan buryall at the discresion of myne executors.

Item I grant and give and bequeathe unto Richarde Warrye my sonne the seatte of my bargayne called Kynetsons Well lyinge in the parish of Crickett Thomas.

Item I give and bequeath unto Robert Warrye my sonne twenty poundes of money.

Item I give and bequeath to Margarett Warrye daughter of John Warrie my sonne twenty pounds of money.

Item I give and bequeath unto every of my sonnes beside the forenamed Roberte Warrye twenty nobles apiece in money.

Item I give and bequeathe to everie of my said sonnes two kyne apiece.

Item I give and bequeathe to  Edyth Bondige my daughter two kyne also.

Item I give and bequeathe to my said daughter Edyth Bondige twentie nobles in money.

Item  I give and bequeathe to every of my childrens children one sheepe apiece.

Item my legacies discharged and my debts aside I make and ordayne my well beloved wife Margaret Warry my sole executor of this my last will and testament.

And for overseers I doe appoint my sonne John Warrie and my sonne in lawe William Bondige.

In witness of the truth I have hereto set my hande and seale.

Given the thirteenth day of October in the nyne and thirtieth yeare of the reigne of our sovereigne Ladye Elizabeth the Queene that nowe is 1597

Will of Henry Warry , Cudworth, Proved at the PCC 14 August 1612

 

In the name of God amen. I Henry Warry of Libnarsh in the parish of Cudworth doe make my last will and testament in manner and forme following. The 24th daye of March 1611.

First I give and bequeath my soule unto Allmightie God and my bodye unto the earth beinge in good and pfecte mynde and remembrance thankes be to God for it.

Item I give and bequeath one suit of prll next unto the best unto my brother John Warrye. As for all my other goodes moveable and unmoveable I give wholelye unto Edward North whome I make my whole  Executor.

Will of John Warry the Elder, Chard, Proved at the PCC 5 May 1631

 

In the name of God amen. The fifteenth day of November in the yeare of our Lord God One Thousand Six Hundred Thirty.

I, John Warry the elder of Perry Streete in the parish of Chard in the countie of Somersett yeoman aged and week in body but of good and perfect memory (God be praised) doe make and ordaine this my last will and Testament in manner and forme following. That is to say first I commend my soule into the hands of God my maker hopeinge through the merritts of Jesus Christe my Saviour to bee made pertaker of life everlastinge. And as concerning my lands goods and chattels my minde and will is as followeth.

Firste I give and bequeath unto the Parish Church of Chard the some of tenne shillings to bee imployed towards the buyinge of a book comonly called the booke of Martyres to reamine in the said church for ever.

Item I give and bequeath unto the poore of the parish of Chard thirtie shillings.

Item I give and bequeath unto George Wary and William Wary my sonnes all my implements of house and housholdstuffs in my house at Weeke in the parish of Axminster to bee equallie divided between them. To bee delivered unto them immediately after the death of my wife or after her widowhoode the which of them doe first happen to come to passé.

Item I give and bequeathe unto the said George and William my sonnes twentie pounds apiece to be paid within sixe monthes after my decease.

Item I give unto Mary my wife tenne Ewes of a middle sort and my black grayemaid.

Item I give and bequeathe unto Mary my daughter now the wife of Thomas Deane the some of three score pounds in liewe of her marriage portion to bee paid unto her within one year next after my decease.

Item I give and bequeath unto Elizabeth Wary one hundred and thirtie pounds of lawfull English money to be paid her within one year next after my decease.

And alsoe one feather bedd with a bedstead bolster and all other furniture thereunto belonginge.

Item I give and bequeath unto Robert Wary my sonne all my grounds called Lutsole with the lease thereof and all my estate right title terms and interests therein.

Item I give and bequeath unto the said Robert Wary the some of three score pounds of lawfull English moneyto be paid within one year after my decease.

Item I give and bequeath unto Richard Wary my sonne all my tenements and grounds called Colpittfield and Broadfiled and all my estate right title terms and interests therein together with my lease and writinge thereof. And I also give and bequeath unto the said Richard my sonne fortie pounds of lawfull money of England to be paid within one year after my decease.

Item I give and bequeath unto my sonne Augustine Wary all that my house at Tatworth now in the occupation of one John Boyt and all that ground and closes thereunto used and belongings together with my lease thereof and all my right title terms and interests therein. And I also give and bequeath unto the said Augustine the some of three score pounds to bee paid within one yeare next after my decease.

Item I give unto every one of my son John hys children three pounds apiece.

Item I give and bequeath unto every one of Thomas Brownes children three pounds apiece.

Item I give unto every one of the children of Robert Wary my sonne that shall be livinge at my decease three pounds apiece.

Item I give and bequeath unto every one of the children of the said George my sonne that shall be livinge at my decease three pounds apiece.

Item give unto everyone of the children of Thomas Pynny tenne pounds apiece.

Item I give and bequeath unto Thomas and Jane the children of John Bowridge three pounds apiece.

Item I give devise and bequeath unto John Wary eldest son of the said Richard Wary my sonne all that one house in the south street at Axminster in the county of Devonwith the herb garden thereunto adjoininge and belonginge.And alsoe one other house and all those six several closes of land arable meadows and past re cont. by estimation thirteene acres more or less late in the tenure of one John Holland deceased situate and lyinge in the south part of a certain piece of ground called Symondowne in the parish of Axminster aforesaid and wich I lately purchased to me my heirs and assignes of Richard Cloade Knight by hys indenture or deed of Feoffment bearing date the fourteenth daie of March in the third year of the Raigne of King Charles of England. And alsoe and singular other such lands and tenements woods underwoods with hedgerows and hereditaments whatsoever to mee granted and conveyed in and by the said deed of Feoffment. And also the same deed of Feoffment to have and to hold the same houses and six closes and other the said lands Tenements and premises to me granted in and by the same deed of Feoffment and every part thereof unto the said John Wary sonne of the said Richard and to the heirs of the said John forever. And for default of such issue the remainder therof unto the eight heirs of the said Richard my sonne for evermore.

Item next I give and bequeath unto the said John sonne of the said Richard my sonne five pounds to be paid when he shall accomplish the age of one and twenty years.

Item I will that my executors hereafter named shall keep and maintain the said John Wary sonne of the said Richard until he shall accomplish the age of fifteen years.

Item I give and bequeath unto everyone of the children of the said Richard Wary except the said sonne John three pounds apiece.

Item I give unto Christopher Jeanes sonne of John Jeanes two ewes.

Item I give and bequeath unto the said Mary my wife two of my best ewes and one feather bedd and all the furniture thereunto belonging.

Item I give unto Richard Lowde fortie shillings and unto his wife fortie shillings.

Item All the rest of my goods and chattels whatsoever not hereunto given I give and bequeath unto my sonne John Wary whom I make and ordain my sole and whole executor of this my last will and testament.

And I doe request my loveinge friends Thomas Browne and Hugh Walsh to bee overseers of this my last will and testament. And for theire paines therein I give them twentie shillings apiece. And in witness that this is my last will and testament I have hereunto sett my hand and seale the daie and yeare first above written.

Will of Agnes Warry, of Forton ,Chard  Proved at the PCC 6 May 1642

 

In the name of God amen. The twelfth day of March I Agnes warry of Forton in the parrish of Chard widdowe sicke of body but perfect of memoury (thankes be to the almighty God) I doe ordaine and make this my last will and testament in manner and forme followinge. First I commend my soule unto allmightie God my maker and redeemer and my body to the earth whensoever yt shall please God to call me out of this sinfull world.

Item I give to the parrish church of Chard tenn shillings.

Item I give to the lane ten shillings.

Item I give unto Elizabeth Warry my youngest daughter one hundred and tenn poundes.

Item I give unto Agnes james one shilling and my executor to putt her name in upon their lineing and to pay for it.

And unto Jane Manly yf that her husband die by any meanes unto her or unto her children then my executor give the said Jane Manly twenty five pounds.

Item I give unto Elizabeth my daughter the biggest brasse caldron a crocke and a pann and posnett.

Item I give Anna Trott my daughter one shilling and soe to be performed within one yeare after my death.

I doe ordaine my sonne John Warie to be my whole executor of all my goods within dores and without. And I doe give all my right and the lease of the parstanes unto him and all my bonds and bills which are due unto me.

One thousand six hundred forty one. The marke of Agnes Warry John Welsh the mark of Richard Lumbard.

                              

 

Will of John Warry, of Perry Street Chard, Proved at the PCC 10 April 1647

 

In the name of God amen. I John Warry of Perri Streete in the parish of Chard in the Countie of Somersett yeoman beinge sickly and weake in body but of good and perfect memory God be praised doe make and ordaine this my last will and testament in manner and forme followinge

That is to say First I commend my soule into the hands of Allmightie God my maker hopeinge assuredly through the only merritts Jesus Christ my saviour to be partaker of life everlastinge. And my body to the earth whereof it was made.

And my lands and Tenements goods and chattels I will and devise as followeth

That is to say unto the poore of parish of Chard I give twenty shillings to be distributed and divided amongst them as my wife shall thinke good.

And I the said John Warry doe hereby devise will and bequeath unto my sonne John Warry and the heires of his body lawfully to be begotten all those my lands and tenements  messuages and hereditaments wherof I am seised in fee to me and my heires situate and lyinge and beinge at Perri Streete in the parish of Chard aforesaid now in my occupation or in any others and for default of such issue of the body of the said John Warry my sonne my will is and soe I devise that the same lands Tenements messuages  and hereditaments shall come and remaine unto my sonne William Warry and the heires of his body lawfully to be begotten.

The remainder thereof unto George Warry my sonne and the heires of the body lawfully to be begotten .

The remainder thereof unto Richard Warry my sonne and the heires of his body lawfully to be begotten.

The remainder thereof to my owne right heires.

Item I give and bequeath to Katharine my wife the parlour and chamber over and buttery and kitchen of this my now dwellinge house in Perri Streete  aforesaid with ingresse egresse and regresse into and from the same by and through the hall and entry of the same house. And also libertie and power to perceave and take the fruit of the trees of the higher orchard and nurcery therein and herbes in the gardens for her necessary use in the household

And alsoe all those my closes of land and pasture called Dykehill Ashe Close made with the apputeenances for and duringe the naturall life of her the said Katharine for a competent joynture for her and and in full recommence and satisfaction of her dower of and in my lands and Tenements And I doe further bequeath and devise unto my said wife the halfendeals of my beddinge linen woollen and other householdstuffe now in and about my said house

And I doe moreover give unto her all her nowe waaringe apparel and my little bay mare .

Item my will is and I doe advise and require my sonne John Warry to grant and convey to Richard my sonne and his heires the fee simple and inheritance of all my lands and Tenements with the apputenances lyinge and being in Westford and Parke within the parish of Thornecombe in the Countie of Devon which I late purchased for a terme of yeares with a remainder in fee unto Richard a former sonne of mine whoe is sithence dead and that my said sonne Richard now lyingepay the chardge of the said conveyance and that the same shall be done upon request made by the said Richard or the said Katharine his mother.

Item I give will and devise unto George my sonne all that cottage and little Tenement with the grounds thereto used and inioyed lyinge and beinge in Tatworth within the parish of Chard aforesaid now in the tenure of one William Carswell to have unto him the said George his executors and assignes for and duringe the full terme and time of fourscore and nineteene years to be accompted from the day of my death and from thencefourth fully to be compleat and ended under the yearly rent of one shillinge during the said terme provided allwayes my will is that my sonne John and his heires shall have and receave the rent of the said cottage payable now by the said Carswell duringe his land and estate therein.

Item I will and devise unto Henry Warry and William Warry my brothers all those my closes lands meadows and pastures lyinge and beinge att Westford and Parke within the said parish of Thornecombe for and duringe the terme of tenne yeares next ensuinge the day of my death upon trust and confidence and for the better education and livelihood of William my sonne and Hellen and Jane my two daughters and for raysinge portions for my said daughters in manner and forme followinge to wit That the first yeares profits shalbe for the whole and sole benefit of the said William my sonneand the residue of the said terme for the benefit of the said Hellen and Janeand if any of them the said Hellen and Jane die before her age of seventeane yeares then my will is the one halfendeale of the parte and portion of her soe dyinge shall accrew and come on to the survivor and the other halfendeale thereof unto the said Richard my sonne. And my will and intent is

And I doe devise and bequeath unto William and George my sonnes my three closes of land meadowe and pasture with the appurtenances called Lawman meadow Stawle Close and Little Woodlie conteyninge by estimation in the whole nine acres and halfe lyinge at Westford aforesaid To have to them from and after the end and expiration of the said tenne yeares until the decease of mie said wife and after her decease and the end of the said tenne yeares then my will is and I soe I devise that the said George my sonne his executors and assignes shall have hold and injoy all the said three closes called Lowman Meadow Stawle Close and Little Woodlie for and during all the remainder and interest of my terme and estate therein.

Item I will bequeath and devise unto my said sonne Richard his executors and assignes all those my eight closes of land meadowe and pasture lyinge att Parke aforesaid within the said parish of Thornecombe to have to him the said Richard his executors and assignes from the end and expiration of the said tenne yeares for and duringe all the rest and all the remainder and interest of my terme and estate therein.

And morever I give and devise unto my said two daughters Hellen and Jane thirtie pounds apiece to be paid within one yeare next after my decease provided that if any of them die before the payment thereof then the survivor shall have the whole.

Item I give more unto my said sonne Richard tenne pounds to be apid unto him within one yeare and halfe next after my death.

And unto my said sonne William I give fifteene pounds to be paid alsoe within one yeare next after my decease.

Item I give unto my cozen Edith Bowridge my servant Matthew Lane and Mary Woolmington sixe shillings and eight pence apiece.

And now of this my last will and testament I make and ordaine John Warry my said sonne my whole and sole executor giveinge and bequeathinge unto him all my goods and chattels not before given after my debts and legacies paid and funeral charge defrayed.

In witness whereof I have hereunto sett my hand and seale the last day of Aprill in the nineteenth yeare of the reigne of our soveraigne Loed Charles by the Grace of God of England Scotland France and Ireland Kinge Defender of the Faith. Anno Domini One Thousand sixe hundred forty three.

Will of George Warry, Axminster, Proved at the PCC 7February 1670/71

 

In the name of God Amen. The second day of March in the nineteenth yeare of the reigne of our Sovereigne Lord Charles the second by the grace of God King of England Scotland France and Ireland defender of the faith or Anno Domini 1666.

I George Warrey od Axeminster in the county of Devon Yeoman being in poore health of body but

of sound and perfect memory for the which I doe give God hearty thanks doe hereby make and declare my last will and testament in manner and forme following viz

First and principally  I commend my soule into the hands of Almighty God my Creator Saviour and Redeemer and my body to Christian burial when it shall please Almighty God to separate my soule from my bodyand as touching the wordly estate which God in his bounteous Mercy hath lent me here in this life I doe give dispose and devise as followeth.

First whereas I doe stand interested and possessed of certaine closes and parcels of ground commonly called or known by the name of Marles lying and being within the parish of Axeminster aforesaid now in my possession for a certaine number of yeares determinable upon the deceases of William Warrey and Sarah Warrey my children my will is and I doe give and devise unto William Warrey my sonne all and and every the said closes and parcels of groundcalled Marles and all my estate terme and interest that shall bee therein to come and unexpired after my death together with the lease thereof. And moreover my will is and I doe give and devise unto William Warrey my sonne and his heires all that my moyety and halfendeale of all that Messuage and Tenement called Leawards Tenement with the moyety and halfendeale of all the Lands Tenement profits commodities and appurtenances thereunto belonging or apperteyning situate lying and being in Weeke als. Northweeke in the parish of Axeminster aforesaid to have and to hold the said moytye and halfendeale of the aforesaid Messuage and Tenement with the appurtenances unto the said William Warry my sonne from and after the decease od me and Edith my now wife to him and his heires and assignes forever.

Item I doe give and bequeath unto Sara Warrey my daughter the sume of one hundred pounds of lawfull money. To be paid unto her within two yeares next after my death.

Item I doe give and devise unto the said Sara Warrey my daughter all that messuage and Tenement with the appurtenances and six severall closes of land arrable meadow and pasture conteyning by estimation thirteene acres or thereaboutsparcell of the Mannor of Northweeke aforesaid neyre adjoining to Symon Downe scituate lying and being within the parish of Axeminster aforesaid late in the tenure of Robert Hoskins or his assignes. To have and to hold the said lastmentioned messuage and Tenement and the said six severall closes and parcells of land arable meadow and pasture  with the appurtenances mentioned to be late in the tenure of Robert Hoskinsunto the said Sarah my daughter and to the heires of her body lawfully to be gotten and for default of such issue the remainder thereof to the said William Warrey my sonne and to his heires and assignes forever.

Item I doe give and bequeath unto Mary Cogan my daughter the sume of tenne pounds.

Item I doe give and bequeath unto Robert Cogan and to Mary Cogan her children the sume of tenne pounds apiece.

Item I doe give unto George Warrey my grandsonne the sonne of John Warrey my sonne the sume of tenne pounds to be paid unto the said George Warrey my grandsonne when he shall accomplish the age of one and twenty years.

Item I doe give unto John Warrey my sonne the sume of twenty shillings.

Item I doe give unto Elizabeth my daughter now the wife of Robert Coad the sume of five pounds.

Item I doe give unto Edith my daughter the sume of twenty shillings.

My will is and I doe hereby devise that Edith my wife shall have the use and manuell occupation of all my household stuffe during the terme of her naturall life and after her death the said householdstuffe shall remaine amongst all my children that shall be living at the tyme of the death of my said wife equally amongst them. The residue of all my goods chattels and credits sume and sumes of money and all other my goods whatsoever not herein now given devised nor bequeathed my funeral expenses discharged I wholly give and bequeath unto Edith Warrey my said wife whom I doe make and ordaine to be my Executrix of this my last will and testament.

In the name of God amen. I John Warry of the parish of Chard in the County of Somersett yeoman being sick and weake of body but of perfect sense and memory thanks be to God doe make this my last will and testament in manner and forme following. And I doe also hereby revoke all former wills heretofore by me at any time made. Imprimis I give and bequeath my soule unto almighty God hoping in and through the merits of Christ my saviour he will pardon all my sinnes and receive me to his heavenly kingdom. And my body to Christian buryall.

Item I give unto my mother one hundred pounds  and to my sister Elenor fewer score pounds to be added to the six score pounds given her by my father.

Item I give unto my brother William twenty pounds and all my part of that household stuff in Perry Streete House which was jointly given to me and to my mother to be equally divided between us by my father deceased.

Item I give to my brother George his three children to each of them tenn pounds.

Item I give unto my brother Richard his two children to each of them tenn pounds within one yeare after my decease the said summs to be paid.

Item I give unto my sister Jane her six children tenn pounds to each of them to be paid as they shall accomplish the age of one and twenty years successively.

In the meanwhile my will is that the said summes remaine in my Executors hands to be improved for them as he shall see fitt and in case any one or more of them shall happen to dye before they shall accomplish that age than theire part or parts shall remaine to those that shall survive to be equally divided betweene them.

Item I give unto my brother George twenty pounds to the use and for the better livelihood of my sister Jane.

Item I give unto my brother Richard all my land being in Wambrooke which I lately purchased.

Will of William Warry, Chardstock, Proved at the PCC 31 May 1684

 

In the name of God Amen. I William Warry of the parish of Chardstocke in the county of Dorsett gent being weake of body but of good and perfect memory thanks be given unto Allmighty God doe make and ordain this my last will and testament hereby revokeing all other wills and testaments whatsoever by me made.

First and principally I commend my soule into the hands of Allmighty God hopeing that in and through the merits death and passion of Jesus Christ my saviour to have full and free pardon and remission of all my sins and to inherit eternall life and my body I comit to the earth to be decently interred at the discretion of my Executor hereafter named and in reference to the disposition of such temporall estate as it has pleased Allmighty Godto bestow upon me. I give and dispose thereof in manner and forme following that is to say  First I give unto the poore of the parish of Chardstocke aforesaid tenne pounds one five I do appoint to be bestowed in clothes for ten of the eldest poor people within the said parish and the other five pounds I doe appoint shall be paid and distributed on Wednesday before Easter Day next and immediately after my decease unto such other of the poore people as my Executors and overseersof this my will shall think fitt and whereas I stand seized to me my heires and assignes forever of and in certaine closes and parcels of land lyinge within the parish of Wambrooke in the said county of Dorsett which I lately purchased of and from Aron Smith I doe hereby give devise and bequeath the same and every part and parcel thereof unto my cozen Isaac Deane my sisters sonne to him and to the heires of his body lawfully to be begotten and for want of such issue then I give and bequeath the same to all the brothers of my said cozen Isaac Deane and to the survivor and survivors of them and to the heires and assignes of the survivor of them forever.

Alsoe I give and bequeath unto my cozen Thomas Deane all those my grounds called Millwell and Keytemoore lying the mannor of Chardstocke with all the terme of yeares yet to come and not expired.

Also I give unto my cozen John Deane  Ford Meadow and all the terme of yeares yet to come and not expired and I doe appoint the said Thomas Deane to pay and discharge the said John Deane from all rates and taxes which shall or may come payable upon Ford Meadow only Ecclasiasticall dues excepted.

I doe give and bequeath to my cozen Jane Bowditch which now liveth with me annuity of five pounds a yeare yearly to be paid to her for and during her naturall life which I doe hereby order and appoint  my cozen Isaack Deane and his heires and assignes to pay the said annuity yearly out of the aforesaid lands lyinge in Wambrooke aforesaid during her naturall life next after my decease.

Also whereas I stand seized in fee to me and my heires of and in a certaine parcel of land which I heretofore purchased of and from Nicholas Putt Esq. Lying at Tatworth within the parish of Charde in the county of Somerset I do give devise and bequeath the same unto my cozen Thomas Warry sonne of my brother Robert Warry for and during his naturall life and after his decease I give devise and bequeath the same unto Thomas Warry the eldest sonne of my cozen Robert Warry and to his heires lawfully to be begotten and for want of such issue then I give the same unto Robert Warrey second sonne and to the heires of his body lawfully to be begotten and for want of such issue then to the right heires of my cozen Thomas Warry eldest sonne of my cozen Robert Warry forever.

Also I give unto my cozen William Warry son of my cozen John Warry of Weeke twenty pounds to be paid within four yeares after my decease.

Also I give unto my cozen Sarah Warry’s three children forty pounds to be equally divided between them when they shall come to the age of one and twenty yeares and one of them do not live to accomplish the age of one and twenty yeares then it shall be equally divided between the two that survive and if two of them happen to dye before they come to the age and accomplish one and twenty yeares  then both of their parts to remain to the third child surviving.

Also I give unto my kinsmen George Warren and William Warren the reversion of my estate called Foxhill lyinge in Axemister after the death of Sarah Warren and Robert Coggan.

Alsoe I give unto my kinsmen Robert Coggan and George Coade sixe pounds and thirteen shillings and fourpence apiece.

Also I give unto all the children of my brother in law Hugh Welch that shall be living at the time of my death tenne pounds to be paid within one yeare after my decease.

Also I give unto my cozen Thomas sonne of my brother Robert Warry one meadow called Meadhamslying within the mannor of Chardstocke all the yeares that are yet to come and unexpired.

Also I give unto Emma Hallet seven pounds to be paid within one yeare after my decease and unto Mary Giles another daughter of my brother Robert

Owsley I give forty shillings per annum to be paid by my executor for the terme of five yeares after my decease to buy her clothes and her acquittances shall be my Executors discharge.

Alsoe I give unto all the children of my brother John Owsley that shall be living at the time of my decease the sume of five pounds apiece to be paid within one yeare after my decease.

Alsoe I give unto my cozen Christopher Jeanes twenty shillings to buy him a ring.

Alsoe I give unto Thomas Wellman five pounds to Emme and all the rest of  my sister Wellman’s children tenne pounds apiece.

Alsoe I give unto Mary Bagwell the wife of John Bagwell the sume of tenne pounds and too all the rest of my brother Robert Warry’s children except my cozen Thomas Warry and my cozen Richard Warry tenne pounds apiece.to be paid within one yeare after my decease.

Alsoe I give unto Margaret daughter of my brother Richard Warry and to Mary daughter of the sister of the said Margaret five pounds apiece to be paid within one yeare after my decease.

Also I give unto my cozen Barnarby Warry one annuity of thirty shillings per annum during his naturall life to be paid by my Executor by quarterly payments that is to say the feast of the birth of our Lord God the annunciation of our Lady St Mary the Virgin, St John the Baptist, St Michael the Archangell by equal proportion the first payment thereof to begin at the first of the feasts which shall first happen after my decease.

Alsoe I give unto all such children of my sister Joane Brown that shall be living at the time of my decease the sume of tenne pounds apiece.

Alsoe I give unto my cozen Arthur Pyny and to my cozen Jane Turner tenne pounds apiece and to my cozen Thomas Pyny and his sonne Thomas five pounds apiece to be paid within one yeare after my decease.

Alsoe I give unto my cozen Thomas Bowditch and his children the sume of fifteen pounds towards the buying of his reversion of the living in which they now dwell to be paid within one yeare after my decease.

Alsoe I give unto my sister Jane Welsh the sume of tenne pounds to be apid within one yeare after my decease.

Alsoe I give unto Edward Larcombe forty shillings and to Mary his wife twenty shillings.

Alsoe I give unto John Handley and Henry Beer and Joane Flood twenty shillings apiece to be paid within one yeare after my decease.

Alsoe I give unto John Welsh senr. And John Searle to each of them one suite of my owne wearing apparrell of the value of thirty shillings each suite or the sume of thirty shillings apiece to be paid within one month after my decease and I give unto these two poore men thirty shillings apiece added to their former legacys to be paid within one yeare next after my decease.

Alsoe I doe nominate and appoint William Deane sonne of my cozen William Deane of South Chard to be the fowerth life put in upon the copy for the filling up of the estate one Ridge

Living which I lately purchased of the Lordes of the Mannor of Chardstocke after the death of Alice Vincent.and my will is that if my cozen Isaack Deane shall ever call the said William Deane at any time hereafter to surrender into the hands of the Lordes of the Mannor aforesaid then the said Isaack Deane shall pay unto the said William Deane for such surrender the sume of one hundred pounds. But my will is that my cousens John and Thomas Deane shall surrender their rights in the aforesaid estate whenever called to it by their brother gratis.

Alsoe I give unto my cozen Isaack Deane all my right and tytle and interest and farmshipp lease of and in the Moores which I lately purchased of Phillip Gillit.

Alsoe I give unto my brother Austin Warry decesade to his sonne John Warry five pounds to be paid within one yeare after my decease.

Alsoe I give unto my cozen Thomas Warry sonne of my brother Robert Warry all my right and tytle in one close called Little Bateleeses parte of Wontton Farme.

Alsoe whereas I have a farmship lease granted to me of Farway living formerley the Welches and have power thereby for certaine yeares   to come and unexpired to fill up and grant a copy or coppies of the said living or tenement according to the customs of the Mannor of Chardstocke I doe give devise and bequeath my said farmshipp lease and all my benefit thereof for the filling up and granting the said Coppyhold Estate according to the customs of the Mannor aforesaid during the whole terme for the doeing of it to me granted unto John Welch and Nathaniel Welch sonnes of my cozen Hugh Welch to be equally divided between them and the said John and Nathaniel are to pay unto their sisters

the sume of tenne pounds out of the aforesaid estate and it is to be equally to be divided amongst and between all their sisters .

Alsoe whereas I have a farmship to me granted as aforesaid of Phillip Gilletts tenements and I hath power thereby for certaine yeares yet to come and unexpired to fill up and grant a Coppy or Coppyes of the said tenement according to the customs  of the Mannor of Chardstock, and whereas I have before given some parte of the said tenement unto my cozen Isaac Deane I doe now give the other parte and bequeath it unto my cozen John Deane the other parte of the farmeship lease during the terme   according to the customs of the said Mannor to fill up and put in lives.

Alsoe whereas I stand seized for terme of my life by copy of Courte Roll according to the customs of the Mannor of Chardstock in one other tenement called Whitehouse where I now liveth and have power by vertue of a farmeship lease thereof at any time during the terme of yeares yet to come and not expired to fill up and grant a copy or copyes of and to the said tenement according to the custome of the Mannor I doe give and bequeath the farmeship lease and all my benefitt thereof  during the terme yet to come and unexpired to my nephew William Warry sonne of William Warry my cozen of Axeminster together with all my right tytle and interest in one other tenement adjoining to Whitehouse aforesaid called Rockey lately in the possession of John Wekely gent or his assignes.

Alsoe I give and bequeath unto my said nephew William Warry all and singular my householdstuffe whatsoever and wheresoever.

Alsoe I give unto my servant Alice Every that now liveth with me twenty shillings to be paid within one yeare after my decease.

Also I give unto my cozen Edith Warry the daughter of my brother George Warry one annuity of two pounds per annum yearly to be paid to her after my decease by even and equall proportions at the four most usuall feasts in the yeare the feast of the birth of our Lord and Saviour the annunciation of our Lady St Mary the Virgin, St John the Baptist and St Michael the Archangell the first payment thereof to be made on such of the said feasts that shall next happen after my decease  the said annuity shall be paid by my Executor for and during the terme of her naturall life.

All my other goods chattels moneys and credits not before by this my last will and testament given or bequeathed I devise and bequeath unto my cozen William Warry of Axeminster my brother George Warrys sonne of Weeke whom I make and ordaine my whole and sole Executor of this my last will and testament.

And I doe desire my kinsman William Deane of Southchard and Richard Warrey of Dickhill to be my overseers of this my last will and testament and see that the same be performed in all things according to my true intent and meaning and for their pains and care therein I give unto each and both of them the sume of eleaven pounds apiece in witnesse that this is my last will and testament containing four sheets of paper together with a parchment labell I have to the same put my hand and seale the first day of Aprill in the yeare of out Lord God one thousand six hundred eighty foure – 1684.

Will of Thomas Warry,  of West Coker,  Proved at the PCC 03 July 1740

 

In the name of God amen. I Thomas Warry of West Coker in the county of Somerset Gentleman being weak of body but of sound mind and disposing memory thanks be given to almighty God for the same do make and ordain this as my last will and testament in manner and form following Imprinns I give and bequeath unto my son Thomas Warry and his assigns for and during the term of his natural life all my messuages or Tenements and premises lying and being within the said parish of West Coker except the messuages or tenements lands and premises hereinafter particularly mentioned and devised and from and immediately after the decease of my said son Thomas Warry I give devise and bequeath all the aforesaid messuages lands and tenements and isoreditaments unto my grandson Thomas Warry his heirs and assigns for ever subject howertholefs to this provisor and limitations hereinafter mentioned and if it shall happen that any of the aforesaid lands or tenements are held for along term or terms of years then I give and bequeath such leasehold estate or estates unto my said grandson his Executors Administrators and assigns from and immediately after the decease of my said son for and during all the term or terms of years that shall be therein then to come and unexpired .

Item I further give devise and bequeath unto my said grandson Thomas Warry his heirs and assigns forever all that my iviosonage or dwelling house garden orchard closes lands hereditaments and premises with the appurtenances which I purchased of  

 

 

Will of Joseph Warry, St Mary Le Strand, Proved at the PCC 9 Sep 1822

 

This is the last will and testament of me Joseph Warry of Old Bettys shop and Coffee house in the Strand in the parish of St Mary Le Strand in the County of Middlesex, Coffee House Keeper which I make publish and declare in manner following, that is to say I give and bequeath unto my dear wife Elizabeth and to my friend Sir Robert Suaro of Ruistor Street in the parish of Saint Mary in the borough of Reading in the County of Berks booksellor and stationer their executors and administrators all and every my household messuages or toucments with the apputenances and also all my stock of wine beer and spirits and all other my household furniture plate and linen book and other debt and debts issues and securities for money and all and every other my personal estate and efforts whatsoever and whosoever to hold the some and every part thereof unto my said wife and the said Robert Suaro their executors administrators and assuj us to for and upon the several trusts intents and purposes hereinafter mentioned and declared of and sourcing the same (that is to say) upon trust in the first place that he the said Robert Suaro do and shall pay by and out of the said trust monies estate and efforts or a sufficient part thereof  raise pay and retain to himself the sum of nine hundred and seventy two pounds or such other sum or sumsof money be the same more or less as I shall be indebted to the said Robert Suaro at the time of my decease together with lawful interest for the same at such time or times as the said Robert Suaro shall judge to be most suitable and to the mutual benefit and awoaut aye of himself and my wife in the discretion and integrity of the said  Robert Suaro   and I do declare that in the meantime and until such sum and sums as I shall be indebted to the said  Robert Suaro at the time of my decease with interest for the same shall be fully paid and satisfied the whole of my said estate and efforts whotsoever and wheresoever shall be subject and liable to the said debt and debts due and owing from me to the said  Robert Suaro at and interest for the same as aforesaid and subject thereto as aforesaid and also subject to the payment of all my other just debts funeral and testamentary expenses upon further the trust and to the intent my said wife do and shall take and enjoy all and every my stock of wine porter beer and liquors and all other my stock in the trades or businesses of a shop and coffee house and Liquor Merchant together with my household and other furniture plate china linen fixtures and other utensils and things used in the  said  Robert Suaro now or which at the time of my decease shall be occupied by me as a shop or coffee house and liquor shop (a correct inventory and valuation of all such stock and other personal estate and effects being made and the same being sourced by my said wife and the said  Robert Suaro which I direct may be done as soon as towomonly may be after my decease and by and with the advise and assistance of the  said  Robert Suaro and also with the assistance of such waiters or other servants as my said trustees shall retainand employ for that purpose and manage and carry on my said trades or businesses of shop and coffee house keeper and retailer of wine beer and spirituos liquors at the said messuages or toucments and premises now occupied by me for that purpose or at such other toucments messuage or messuages and premises as my said trustees shall occupy for that purpose and retain rejoice and take the clear years profits increase and advantages arising thereof for the use and benefit of my said wife and to enable her the better to support and to bring up my children until the youngest or youngest surviving child shall attain his or her age of twenty one years or my said wife shall depart this life or marry again or on my youngest or youngest surviving child attaining his or her age of twenty one which shall first happenor before the happening of any or other of those events in case my said trustees shall think it more productive to the interest of my said wife and family to dispose of and give up the said trades, the lease or leases goodwill stock and all my other personal estates and effects whatsoever which appertain to the said trades or businesses and every part thereof for the best price and most money that can be obtained for the same whether by public auction or private coutrout  and appraisement or otherwise and do and shall stand possessed of and entitles to the monies to arise from the means aforesaid and to be collected yet in and recovered from the debts and securities for money due to and giving to me at the time of my decease and all other my personal estate and effects not used or employed in the said trades or businesses (after and subject to the expenses of selling and transferring my said trades or businesses and the expenses incidental to converting the other part of my personal estate into money) upon the several trusts and for the several intents and purposes next hereafter  mentioned that is to say in trust to most the monies to arise by all or any of the means aforesaid in the purchase of some government stock or fund or on the security of real estates in England and do and shall standpossessed of and interested therein upon trust that my said wife (if thou living shall receive and take the interest dividends and annual produce of the said trust monies for and during the term of her natural life or until she shall marry again and from and immediately after the decease or marriage of my said wife which shall first happen)in trust that my said trustees and the survivor of them or the executors or advisors of such survivor do and shall in case my said wife shall marry attain pay unto or permit my said wife to retain to her sole use the royalty or sum of three hundred pounds and which I give and bequeath to her accordingly and after payment thereof do and shall pay assure and transfer my said trust monies estate and effects unto and amongst them share and share alike as tenants in common and not as joint tenants when and as the youngest or youngest surviving child shall attain his or her age of twenty one years but in case my said wife should die and marry again before my youngest or youngest surviving child shall attain twenty one years of age thou in trust  that my said trustees and the survivors of them and the executors and advisors of such survivor do and shall receive the whole of the said interest dividends and annual produce from time to time shall become due and payable and pay apply and dispose of the same or a sufficient part thereof for and towards the education maintenance and support and bringing up of such of my children as shall then be under the age of twenty one years until the youngest or youngest surviving child shall attain his or her age of twenty one years and when and as such youngest or youngest surviving child shall attain the age of twenty one years in trust to pay assign and transfer all the said trust monies and residue of my estate and effects with the interest dividends and produce thereof equally unto and amongst all and every my children share and share alike as tenants in common and not as joint tenants and in case any or other of my said children shall happen to die under the age of twenty one years without leaving issue of their body or bodies lawfully begotten thou tywo and bequeath the share or shares of such deceased child or children to be equally divided unto  and amongst the survivors or survivor of them my said children when and as the original share or shares of such survivors or survivor shall become vested in thru if more than one share and share alike as tenants in common and not as joint tenants and to become due and payable when and as their his or her original shares or share shall become respectively vested due and payable but in case any or other of my said children shall happen to die under the said age of twenty one years leaving issue of his her or their body or bodies lawfully begotten then in trust to pay  assign and transfer the part or share of such deceased child or children unto such his her or their respective issue share and share alike (if more than one) when and as soon as he she or they shall severally and respectively attain their several and respective ages of twenty one years and to pay and apply the interests dividends and produce thereof in the meantime for and towards their respective maintenance and education and I do hereby authorise  and empower my said trustees or the survivor of them or the Executors or Administrators of such survivor from time to time as often as they shall think proper to alter and change the securities on which all or any part of the said residue of my said estate and effects shall or may hereafter be placed out and from time to time as often as they shall think fit again to place the same out upon other government or such other good and sufficient real security or securities in England as they shall think proper and I do hereby also authorise and empower my said trustees or the survivor of them or the Executors or Administrators of such survivor to apply the respective part or share of any or other of my aforesaid children or the respective part or share of their lawful issue in case any or other of them should die under age leaving issue as aforesaid of and in the said residue of my estate and offer to for putting any or other of my said children his her or their lawful issue apprentice or out to business or any suitable employ or advocating him her or their respectively in any employ or otherwise  for his her or their respective advancement in the world anything in this my will contained to the contrary thereof in any wise notwithstanding provided always and I do hereby declare that my said trustees hereby nominated and each of them and the Executors Administrators and assuges of them and each of them shall be charged and chargeable rosply only for such monies as they or either of them shall respectively actually receive by virtue of the trusts hereby in them reposed notwithstanding their or other of their giving or saying or joining in giving or saying any receipt or receipts for the sake of conformity and that any one of them shall not be answerable or accountable for the other of them or for the arts receipts moglorts or defaults respectively and that they or other of them shall not be answerable or accountable for any Banker Goldsmith Broker or other person with whom or in whose hands any part of the said trust monies shall or may be deposited or lodged for safe custody or otherwise in the Execution of any of the trusts hereinbefore mentioned and that they or either of them shall not at any time be answerable or accountable for the insufficiency or docisionry of any security or securities stocks or funds in or upon which the said trust monies or any part thereof shall be placed out or invested nor for any other misfortune loss or damage which may happen in the Execution of the aforesaid trusts or in relation thereunto except the same shall happen by or through their own wilful default respectively and also that it shall and may be lawful to and for my said trustees and each of them their and each of their Executors Administrators and assuges by and out of the monies which shall come to their respective hands by virtue of the trusts aforesaid to retain and reimburse herself himself and themselves respectively and also to allow to her or his co trustee all costs charges damages and expenses which they or either of them shall or may suffer sustain expenddisburse be at or be put to in or about the Executors of any the aforesaid trusts of this my will or relation thereunto respectively and I do hereby nominate constitute and appoint my said wife and the said Robert Suaro Executrix and Executor of this my last will and testament and guardians of all and every my infant children hereby revoking all former and other wills by me made I publish and declare this only to be my last will and testament in witness whereof I the said Joseph Warry the testator have to this my last will and testament contained in six sheets of paper set my hand and seal as follows to wit my hand to each of the two proceeding sheets near the bottom I make this my last will and testament. I give bequeath and devise all my goods chattels monies and property of whatsoever sort and kind unto my two nieces Jane ans Sarah Warry daughters of my late brother William Warry to be divided between them in equal proportions share and share alike and thereal intent and meaning of this my will and testament is that my said nieces Jane and Sarah shall have hold and possess all and whatsoever I can possibly leave and bequeath unto them and I appoint my said niece Jane sole Executrix of this my last will testament written signed and sealed by me this tenth day of January 1823

 

Appeared  personally John Warry of Poplar in the county of Middlesex Esquire and Mary Elizabeth Allen of Ealing in the same county spinster and being sworn on the Holy Evangelists make oath that they know and were well acquainted with the Reverend Thomas Warry late of Ealing in the county of Middlesex Clerk services for some time before and nearly upto the time of his death also with his manner and character of handwriting and subscription having often seen him write and subscribe his name and having varsfully viewed and perused the paper writing hereunto annoted purporting to be and contain the last will and testament of the deceased beginning this “ I make this my last will and testament”ending thus “this tenth day of January 1823” and thus subscribed Thomas Warry.They the appearers further make oath that this whole body series and contents of the said paper writing beginning and ending as aforesaid and also the subscription thereto were and are of the proper handwriting and subscription of the said deceased as they verily and in their consciences believe signed John Warry – Mary Elizabeth Allen on the 29th November 1823 the said John Warry and Mary Elizabeth Allen were duly sworn to the truth of this aforegoing affidavit before me E Coote Surrt Pst   Perrot ffonton Notary Public

 

Proved at London 31 December 1823 before the worshipful Joseph Phillimore Doctor of Law and Surrogate by the oath of Jane Warry spinster the niece the sole Executrix to whom Admon was granted being first sworn duly to Adin
