German Exit Tax - All around the world, there are many different views and opinions when it comes to the german exit tax. Many feel that the tax infringes the fundamental freedoms of the EC Treaty, while others feel that it isn’t that bad. Pretty much the same as the French exit tax, the german exit tax rules violate the freedom of establishment principle.
Under the german exit tax, a resident taxpayer that has held equivalent to a 1% direct or indirect participation in a German company during the previous five years will be subject to capital gains tax on unrealized gains when that taxpayer relocates to another country or area. Taxpayers that remain German residents are taxed only when capital gains happen to be realized – which is few and far between.
When you compare United States taxes with the german exit tax, you’ll see quite a distinct difference. The United States has very unique taxes, with Germans having the exit. As weird as it sounds, there have been many Americans moving to Germany – and many Germans moving to the United States. As you probably know, taxes are a part of life, no matter where you decide to live.
The consequences left by the german exit tax are much more rigid than its French counterpart. The only possibility to defer payment of the German tax is to apply to pay the tax in installments. French provisions allowed deferral up to the time the shares were disposed of. The French tax was automatically waived after five years from the date of emigration if the shares were owned by the same shareholder.
For those who live outside of Germany, the german exit tax is something will be hard to understand. Those who live in Germany know that the tax is outrageous, with many trying to do something about it for years. The harder people try to put an end to the tax exit, the more it seems to imply. Sooner or later, germans can expect for the tax exit to be abolished.
