Debt Collector Law - If you feel like you are constantly being hassled by debt collectors, you should acquaint yourself with the federal debt collector law. This law, also known as The Fair Debt Collection Practices Act (isn’t that a mouthful?) protects the consumer from harassment and unfair debt collection practices of their debtors. Knowing the debt collector law could help you to get your debtors off your case and give you a little breathing room. Simply citing from Public Law 104-208, 110 Stat. 3009 will often be enough to let your debtors know you aren’t ignorant of your rights.
For instance, did you know that under the debt collector law (15 USC 1692d §806(5)) the following is considered harassment: "(5) Causing a telephone to ring or engaging any person in telephone conversation repeatedly or continuously with intent to annoy, abuse, or harass any person at the called number.” Next time your debtors start harassing you with phone calls, just mention that this behaviour is against "the Fair debt collection practices act" 15 USC 1692d Section 805 Subsection 5. Most of the time, by showing that you know your rights, and demanding that your collectors follow the debt collector law, you can save yourself allot of harassment from otherwise obnoxious debtors.
In the same section (1692d, §806 (7)) the debt collector law also states that a debt collector may not make "the placement of telephone calls without meaningful disclosure of the caller’s identity", which more then often happens. In other words, if a bill collector repeatedly calls your residence and refuses to disclose their identity to you (e.g. by saying it is a "private matter"), you can tell them that such behaviour is not only annoying and unacceptable, but is against the law and if they continue in such a manner you can even threaten them with a possible civil law suit. Of course, most of the time it will never get to that point, as your debt collectors will have become wise to you; or rather will know that you have become wise to the debt collector law.
